Drug Offenses
Serious defense. Attention to the person behind the case.
Protecting Your Freedom and Your Future
Substance use disorder is often at the center of the criminal cases Dan handles. When you or someone you love faces possession, trafficking, or another drug-related charge, the defense needs to address both the allegations and what is at stake in that person’s life.
The consequences can extend beyond a sentence to education, employment, professional licensing, and future opportunities. Dan brings experience with serious state and federal drug prosecutions, including trials, to the work of protecting those interests.
Possession, Trafficking, and Aggravated Charges
Dan represents clients facing possession, trafficking, aggravated trafficking, and related conspiracy allegations. He examines what the prosecution must prove, the asserted role of each person, and the evidence used to distinguish possession from trafficking.
In Maine, Class A aggravated trafficking ordinarily carries a four-year mandatory minimum prison term. The law provides for a reduced minimum when specified findings are made. The precise charge, drug, quantity, alleged aggravating factors, and available sentencing relief all require careful review. Federal charges involve a separate sentencing framework and can carry substantial mandatory penalties.
Testing the Prosecution’s Evidence
A drug case may turn on the legality of a stop or search, the reliability of an informant, the attribution of messages or transactions, or whether the evidence actually establishes knowing possession or trafficking. Drug identification, testing, weight, and the handling of physical evidence can also matter.
Dan reviews the investigation closely, considers motions to suppress or exclude evidence, and prepares to challenge the case at trial. That preparation also informs negotiations and the evaluation of any proposed plea.
Treatment and Recovery Court
A defense lawyer handling addiction-related cases also needs to understand Maine’s Adult Treatment & Recovery Courts, often called drug court. Dan evaluates whether a referral may be appropriate and addresses the admission process, legal and clinical screening, proposed plea terms, and the consequences of participation.
Admission is not automatic. These are intensive programs involving treatment, supervision, testing, and regular court appearances. Dan helps clients weigh the opportunity against the obligations and risks, including what may happen if the program is not completed.
Bail and Access to Treatment
Bail is often an immediate priority. Dan reviews release conditions, considers requests for review or modification, and works to present a practical plan when treatment or recovery support is relevant. The aim is to address the court’s concerns while protecting the client’s ability to work, obtain care, and participate in the defense.
Treatment planning and a careful legal defense can proceed together. Dan personally handles the case from the first bail questions through negotiations, trial, and sentencing when necessary.
